Intermediary Status Under IT Act 2000
Legal classification and safe harbour provisions applicable to Flexicartor
Flexicartor Private Limited is classified as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 (as amended). The Company enjoys protection under the safe harbour provisions of Section 79 of the IT Act, subject to compliance with the prescribed due diligence requirements.
- The platform acts solely as an intermediary that provides access to a communication system over which third-party information is transmitted, temporarily stored, or hosted.
- Flexicartor does not initiate the transmission, select the receiver, or select or modify the information contained in the transmission as per Section 79(2) prerequisites.
- The Company observes due diligence in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and subsequent amendments.
- Upon receiving actual knowledge or being notified by appropriate authority, the Company expeditiously removes or disables access to unlawful content as required under Section 79(3)(b).
- The platform publishes and enforces terms of use, privacy policy, and community guidelines in compliance with Rule 3 of the IT Intermediary Guidelines, 2021.

The officer shall acknowledge receipt within 24 hours and resolve the complaint within 15 days from the date of receipt, in accordance with statutory requirements.
