Flexicartor Private Limited is classified as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 (as amended). The Company enjoys protection under the safe harbour provisions of Section 79 of the IT Act, subject to compliance with the prescribed due diligence requirements.

  • The platform acts solely as an intermediary that provides access to a communication system over which third-party information is transmitted, temporarily stored, or hosted.
  • Flexicartor does not initiate the transmission, select the receiver, or select or modify the information contained in the transmission as per Section 79(2) prerequisites.
  • The Company observes due diligence in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and subsequent amendments.
  • Upon receiving actual knowledge or being notified by appropriate authority, the Company expeditiously removes or disables access to unlawful content as required under Section 79(3)(b).
  • The platform publishes and enforces terms of use, privacy policy, and community guidelines in compliance with Rule 3 of the IT Intermediary Guidelines, 2021.

All grievances, complaints, concerns regarding content, privacy, intellectual property, or user conduct on the platform may be directed to the Grievance Officer. The officer shall acknowledge receipt within 24 hours and resolve the complaint within 15 days from the date of receipt, in accordance with statutory requirements.

Governing Law & Jurisdiction

This legal notice and all matters arising from or in connection with Flexicartor's platform operations shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. By accessing and using the Flexicartor platform, users consent to this jurisdiction and venue.
